These terms of service (the “Terms”) are an agreement between you and [Legal business name — pending configuration] (“EverElder”, “we”, “us”), the operator of everelder.org and the EverElder application. They govern your access to and use of the service. By creating an account, joining a workspace, or using EverElder in any way, you agree to these Terms. If you do not agree, please do not use the service.
1.What EverElder is
EverElder is organizational software for family care coordination. It gives a family a shared, private workspace to coordinate support for the person the family supports: assigning tasks, keeping a shared calendar, posting updates, organizing documents and contacts, and tracking shared expenses.
EverElder is a coordination tool only. It does not provide medical care, medical advice, caregiving services, or emergency response of any kind. Section 9 of these Terms describes this boundary in detail, and our Disclaimer explains it further.
2.Who may use EverElder
You must be at least 18 years old to create an account or join a workspace. By using EverElder you represent that you are 18 or older and legally able to enter into this agreement.
If you use EverElder on behalf of an organization — for example, as a professional care coordinator — you represent that you have authority to bind that organization to these Terms, and “you” includes that organization.
3.Accounts and security
You need an account to use EverElder. You agree to provide accurate information when creating your account and to keep it current. You are responsible for everything that happens under your account, so please:
- choose a strong, unique password and keep it confidential;
- do not share your account with anyone else — each family member should have their own account and their own role;
- tell us promptly at support@everelder.org if you believe your account has been accessed without your permission.
We may suspend an account that we reasonably believe has been compromised, in order to protect the family’s information.
4.Workspaces, roles, and owner responsibilities
Information in EverElder lives inside a workspace. The person who creates a workspace is its owner. Owners and administrators decide who joins the workspace, what role each member holds, and what each role can see and do.
As a workspace owner, you are responsible for:
- inviting only people who should have access to the family’s information, and choosing appropriate roles for them;
- making sure you have a lawful basis — and, where appropriate, the knowledge and agreement of the person your family supports — for the information the workspace holds about them;
- removing members and adjusting permissions when circumstances change;
- the workspace’s subscription and billing.
Members act on their own behalf. We are not responsible for disputes between workspace members, though we may step in where our Acceptable use policy is violated.
5.Acceptable use
Your use of EverElder must follow our Acceptable use policy, which is part of these Terms. In short: use the service lawfully, treat every person in and around the workspace — especially the person your family supports — with respect, and do not interfere with the service or with other families’ workspaces.
We may remove content, restrict features, or suspend or terminate accounts that violate the Acceptable use policy.
6.Your content and who owns it
Your family’s information belongs to your family. Tasks, updates, documents, contacts, expenses, and everything else your workspace’s members add to EverElder (“your content”) remains yours. We claim no ownership of it.
So that we can run the service, you grant us a limited, non-exclusive license to host, store, back up, transmit, and display your content — solely as needed to provide EverElder to your workspace and its members, and for no other purpose. This license ends when your content is deleted from the service.
You are responsible for the content you add: that you have the right to share it with your workspace, and that it is accurate enough for the people who will rely on it. Our Privacy policy describes how we handle personal information.
7.Subscriptions, billing, and cancellation
EverElder is a paid subscription service with monthly and annual plans. Pricing, trials, renewals, cancellation, and what happens to your data after cancellation are described in our Subscription policy. Refunds are described in our Refund policy. Both are part of these Terms.
Subscriptions renew automatically until cancelled. You can cancel at any time from Settings → Billing; cancellation takes effect at the end of the current billing period.
8.EverElder is not a medical or emergency service
This section matters more than any other. Please read it carefully.
- EverElder is organizational software. It does not provide medical advice, diagnosis, or treatment, and nothing in the service should be treated as any of those.
- EverElder does not watch over anyone and cannot detect or respond to emergencies. In an emergency, always contact your local emergency services immediately — such as 911 in the United States.
- Reminders and notifications are conveniences that can fail or be delayed. You and your family remain responsible for appointments, deadlines, and obligations.
- Information in a workspace is entered by family members and is only as reliable as what was entered. Verify important information independently before acting on it.

9.Service availability and changes
We work hard to keep EverElder available and dependable, but no online service can promise uninterrupted operation. The service may be briefly unavailable during maintenance, upgrades, or events outside our control. Because availability cannot be guaranteed, please do not rely on EverElder as your only copy of information you would need in an urgent moment — keep critical details, such as emergency contacts, available offline as well.
We improve EverElder continuously and may add, change, or remove features, provided the changes do not materially reduce the core functionality your plan pays for during a paid period. If we ever discontinue the service entirely, we will give you at least 60 days’ notice and a way to export your workspace’s data first.
10.Limitation of liability
To the fullest extent permitted by law: EverElder is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose.
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from your use of — or inability to use — the service. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.
11.Termination
You may stop using EverElder and delete your account at any time. Workspace owners may delete their workspace at any time, which permanently removes its content for every member after the export window described in the Subscription policy.
We may suspend or terminate access if you materially breach these Terms — including the Acceptable use policy — or if we are required to by law. Where reasonable, we will warn you first and give you a chance to fix the problem, and we will provide an opportunity to export workspace data unless doing so would be unlawful or unsafe.
Sections that by their nature should survive termination — including ownership of your content, limitation of liability, and governing law — survive it.
12.Changes to these terms
We may update these Terms as the service and the law evolve. If a change is material, we will notify workspace owners by email and show a notice in the product at least 30 days before it takes effect. Continuing to use EverElder after a change takes effect means you accept the updated Terms; if you do not accept them, you may cancel as described in the Subscription policy.
13.Governing law and disputes
These Terms are governed by the laws of [Jurisdiction — pending configuration], without regard to its conflict-of-law rules. Courts located in [Venue — pending configuration] will have exclusive jurisdiction over disputes arising from these Terms, except where the law of your place of residence grants you mandatory protections or a different forum.
